TERMS OF SALE THROUGH OUR WEBSITE

This page comprises the terms and conditions on which we supply any of the merchandise (“Merchandise”) listed on our website www.intagliolondon.com (“our site”) to you. Please take time to read these terms and conditions carefully before placing orders through our site. By ordering any of our Merchandise, you agree to be bound by these terms and conditions. 

1. INFORMATION ABOUT US

2. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

a) After you have placed an order through our site, you will receive an email that acknowledges we have received your order. Your order is an offer to buy Merchandise from us. All orders received are subject to being accepted by us, and we will confirm our acceptance of your order by sending you an email with confirmation that the Merchandise has been despatched by us. The contract  will only be formed when we send you the Despatch Confirmation.

b) The Contract will relate only to the Merchandise we have confirmed in an email containing our Despatch Confirmation.

c) By placing an order through our site, you agree that you are legally capable of entering into binding contracts and are at least 18 years old.

d) Personalised proofs will be sent via email( PDF), usually within 48 hours of receipt of order. By approving proofs sent by us via email for personalised or bespoke Merchandise that have been ordered by yourself you agree that we cannot be held responsible for any errors detected at a later stage and once production has begun.

3. DELIVERY 

a) Delivery is free of charge to all UK mainland addresses using our standard 3-5 working day delivery service. Any deliveries required next day or to any non-mainland UK address will incur delivery charges as set out on our delivery schedule.

b) Deliveries within the UK must be sent to a valid UK address, we cannot deliver to a P.O box address.

c) Delivery charges and guidance timings  to worldwide destinations are as stated on our delivery schedule.

d) Whilst we will endeavour to meet the timescales in our delivery schedule, we cannot guarantee these timings and will not be liable for any delay in the delivery timings.

e) We require a signature upon delivery of the Merchandise. Please ensure that you or someone that you know (who is at least 18 years old) is available to sign for the Merchandise on the day of delivery.  

4. PRICE AND PAYMENT
a) The price of our Merchandise is as quoted on our site, and can be subject to change at anytime. Any order placed by you will be charged at the rate quoted at the time the order was placed.
b) In the unusual event that the price shown for any Merchandise available on our site may be incorrect, we aim to remedy any error as quickly as possible and will advise you of the correct price. 
c) These prices include (where applicable) VAT but exclude any delivery costs, which will be added to the total amount due as set in our delivery schedule.

d) If we are not able to accept your order, we will either not process your credit  card or refund any money paid by you in relation to that order within seven working days.

e) Payment for all Merchandise must be made via the Paypal button.Payment for non personalised or bespoke Merchandise  must be made when placing your order. We can also accept payment by cheque(sent to our London address) and payment direct to our account but we cannot proceed with your order until payment has cleared.

.f) By submitting an order through our website you confirm that the payment details provided with your order are valid  and that when your order is accepted and processed by us, full payment will be made.

g) We are not responsible for any additional costs that may be charged by your card issuer or bank when your credit/debit card payment for the order(s) you have placed is processed.

h) For card payments, all payments will be subject to authorisation. If the issuer of your payment card  does not for any reason authorise or validate the payment, we will not be responsible for any delay or failure to deliver the Merchandise which you have ordered.

i) Ownership of the Merchandise will only pass to you when full payment has been received, including any delivery charges that might be chargeable.

j) By providing your personal details to us, you authorise us to electronically transmit or to acquire information about you from third parties from time to time, including but not limited to your name, address, telephone number, credit or debit card details or credit reports, to confirm your identity and delivery address for the Merchandise, validate your card payment and for  authorisation of payments for Merchandise.

5. CANCELLATIONS

a) You can cancel your non-personalised order at any time prior to dispatch giving us reasonable time to action this request and to avoid the Merchandise  entering the dispatch phase.  You must call us first and then confirm this in writing to orders@intagliolondon.com

b) If the Merchandise is already at the dispatch phase, we reserve the right to continue with the delivery as per original request, please see our returns policy.

c) You can cancel your personalised or bespoke order at any time before dispatch. However, we reserve the right not to refund the cost of any work completed(or part thereof) or if your order has been completed but is awaiting dispatch, we will not be able to refund any part of the order total.

d) refunds to credit cards will be actioned within seven working days of the day you have given notice of your cancellation.

6.RETURNS

a)If you want to return or exchange any non-personalised Merchandise you must notify us in writing anytime within two weeks (14 days including weekends and public holidays) orders@intagliolondon.com from the day you received your delivery and return them in the condition they were received to: Intaglio London returns department at 16 Old Queen street, London SW1H 1HR

b) Any Merchandise which is due to be returned to us should be insured and sent via a trackable courier. We cannot refund or exchange any Merchandise  due to the non-return of such Merchandise as a result of your courier having lost or damaged the Merchandise in transit.

c) You will be responsible for the cost of returning the Merchandise to us (including the payment of any import duties and/or taxes) unless we delivered the items to you due to an administration error or the Merchandise is faulty. If you do not return the Merchandise as required, we may charge you a fee covering the costs of any import duty or taxes, delivery and any other costs incurred.

d) You must take reasonable care of the Merchandise whilst they are in your possession. If you do not follow this important obligation, we may refuse to accept your instruction.

e) If you claim that the Merchandise is faulty, we will check the returned Merchandise .We will contact you with our findings and if the Merchandise is found to be faulty we will offer a solution including replacement or a refund (this includes reimbursing you for sending the Merchandise back to us). If we agree that a refund is due you should expect to receive the payment of the same within thirty days.

f) It is to be expected that replacement of the Merchandise will take a similar period of time to replace but we will endeavour to improve the delivery timings if at all possible.

7. LOSSES

We will not be responsible for any personal or business losses (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any indirect or consequential loss that is not reasonably foreseeable to both you and us when your order was accepted.

8. IMPORT DUTY

a) If you order Merchandise from our site for delivery outside the UK, you may incur import duties and taxes which are charged when the delivery reaches its  destination. You will be responsible for payment of these import duties and taxes. We have no control over these charges and cannot advise their amount. You should contact your local customs office for further information before placing your order. 

b) You agree that you will comply with that country’s duty/tax laws and regulations. We will not be liable for any breach by you of any such laws.

9. WRITTEN COMMUNICATIONS

 When using our site, you accept that communication with us will be mainly electronic (email).  You agree to our use of electronic communication and that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that these communications be in writing. This condition does not affect your statutory rights.

10. EVENTS OUTSIDE OUR CONTROL

a) We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations under a Contract that is caused by events outside our reasonable control (a “Force Majeure Event”). 

b) A Force Majeure Event includes any act, event, omission or accident beyond our reasonable control and includes (without limitation) the following:
(i) strikes, or any other industrial action.
(ii) civil unrest, riot, invasion, terrorist attack or threat of, war or threat of, or preparation for war.
(iii)  any substantial natural disaster.
(iv) inhibited use of railways, aircraft, shipping, motor transport or other means of private or public transport.
(v) inhibited use of public or private communications networks.

PRIVACY

By sending your details to us you agree that we may use information about you to fulfil an order, to contact you about an order or other products or services that may be of interest to you and for other administrative or operational purposes.

Intaglio London does not disclose or sell our clients personal information to any third party.
